The main charcter Will is introduced in his office where he does advertising. He is going through the process of getting divorced and has a daughter named Maya. Will is also made to appear quite doppy to help the audience warm to the character and he also talks directly to them in a voiceover while narrating what's happening and playing music where he's made to look doppy and comical.
The setting is established in New York where its familiar to the audience and gives them a feeling of comfort as the place is familiar to them and easily recognisable from the shots of the empire state building.

In Definitey, Maybe, Universal Studios is the production company, which is a well known company and is guaranteed to influence viewers and inform them that the feature has high production values. Working Titles is also a well known production company. It's a british company and is popular for distributing romantic comedies which informs the audience of the type of film they're watching.
Working Titles is one ways of identfying the genre of the film, but many other tools are used to do the same thing. Ryan Reynolds who is casted as the male lead is identified with other romantic comedies and is also attractive, which makes the likeliness of him finding romance probable. Another way of identifying the genre is the music played. Will mistakenly plays the audience an upbeat hip hop song, which has comedy value. He then goes on to play a happy, upbeat song, similarily used in other romantic comedies. Will is also experiencing the process of a divorce, which highlights the fact that he's due to be single soon which also insinuates romance and him finding a new partner. While Will is collecting his daughter Maya from school, there's a disturbance over the students having sex ed. classes where some of the dialect said is funny.
